PLEASE READ THESE TERMS CAREFULLY, INCLUDING THE SECTION BELOW ON EMERGENCY MEDICAL SITUATIONS. ORA MEDICAL CLINIC IS A TELEHEALTH-ONLY PRACTICE AND IS NOT AN EMERGENCY SERVICE.


Agreement to Terms

This website (the "Site") and the telehealth services offered through it are owned and operated by Ora Medical Clinic ("Company," "we," "us," or "our"). By accessing or using the Site, scheduling an appointment, or receiving services from us, you agree to be bound by these Terms of Service, our Notice of Privacy Practices & Privacy Policy, and any additional terms that apply to specific services. If you do not agree, you may not use the Site or our services. Any access or use of the Site, whether automated or otherwise, constitutes use of the Site and your agreement to these Terms of Service.

We reserve the right to change these Terms of Service or impose new conditions on use of the Site from time to time. We will post the revised Terms on this website and indicate the effective date. Your continued use of the Site or our services after we post any such changes constitutes your acceptance of the Terms as modified.

Eligibility

  • You must be at least 18 years old to use the Site or receive services from Ora Medical Clinic. We do not provide medical services to, and do not knowingly accept as patients, individuals under the age of 18.
  • You must be physically located in a state where Ora Medical Clinic and its providers are licensed and authorized to deliver telehealth services at the time you receive care. You are responsible for confirming and disclosing your location accurately.
  • You must be able to provide informed consent to telehealth treatment on your own behalf.

Telehealth Services — Nature and Limitations

Telehealth-only practice. Ora Medical Clinic provides medical services exclusively through telehealth (audio, video, and/or secure messaging). We do not maintain a physical clinic location and do not offer in-person visits.

Not for emergencies. Our services are not appropriate for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site or telehealth services to seek emergency care.

Informed consent to telehealth. By scheduling or attending a telehealth visit, you acknowledge that telehealth has inherent limitations compared to in-person examination, that technical issues may occasionally interrupt or degrade a visit, and that your provider may determine that your condition requires in-person evaluation, in which case we will refer you to an appropriate in-person provider or emergency service. As part of the intake process, you will also be asked to review and acknowledge a separate telehealth informed consent, which will be documented in your medical record as required by applicable state law.

No guarantee of treatment. Completing a booking or intake form does not guarantee that a provider will determine treatment is appropriate for you. Our providers exercise independent clinical judgment and may decline to treat, prescribe, or continue care where clinically appropriate.

Provider-patient relationship. No provider-patient relationship is formed until a provider affirmatively accepts you as a patient and begins a clinical encounter with you; browsing the Site or submitting an intake form alone does not create that relationship.

Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not use the Site in any way that could damage, disable, or overburden the Site or interfere with any other party's use of the Site. You may not attempt to gain unauthorized access to any part of the Site, other accounts, or any systems or networks connected to the Site. You agree to provide accurate, current, and complete information when creating an account, completing intake forms, or scheduling appointments.

Appointments and Cancellations

Appointments booked through the Site are subject to availability and provider acceptance. We reserve the right to refuse, reschedule, or cancel any appointment at our discretion, including due to licensing limitations, clinical judgment, scheduling conflicts, errors in pricing or information, or suspected fraud. Cancellation, rescheduling, and no-show policies (including any associated fees) will be communicated to you at the time of booking or in your patient intake materials.

Payments and Refunds

Where payments are accepted through the Site or in connection with our services, you agree to provide current, complete, and accurate payment information. Refund and cancellation policies depend on the type of service and, where applicable, your insurance coverage; specific terms will be communicated at the time of booking or purchase. Payment for a telehealth visit does not guarantee any specific treatment, prescription, or outcome. For questions about a specific charge, contact us at hello@oramedicalclinic.com.

Intellectual Property Rights

Our limited license to you. This Site and all materials on it (including text, graphics, logos, images, and software) are the property of Ora Medical Clinic and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided for your personal, non-commercial use. You may not modify, copy, reproduce, republish, upload, transmit, sell, create derivative works from, or distribute any material from the Site without our prior written authorization. You may download or print individual pages for personal, non-commercial use, provided you keep all copyright and proprietary notices intact.

Your license to us. If you submit material to us (such as intake information, messages, reviews, or feedback) via the Site or related channels, you represent that you have the right to submit it. Clinical information you provide is governed by our Notice of Privacy Practices & Privacy Policy, not by this section. For any non-clinical content you voluntarily submit for public or marketing use (e.g., a testimonial you choose to share), you grant us a royalty-free, worldwide license to use that specific content in connection with our business, subject to your right to request removal.

Medical Disclaimer

Content on the Site (including articles, FAQs, and general health information) is provided for general informational purposes only and does not constitute medical advice. It is not a substitute for individualized evaluation and treatment by a qualified provider. Never disregard professional medical advice or delay seeking it because of something you read on the Site. Only information exchanged directly with your provider during a clinical encounter should be relied upon for your individual care.

Disclaimers

The Site and general informational content are provided "as is" and without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free. This section does not limit or disclaim any duty of care owed to you as a patient by your treating provider during an established clinical encounter, which is governed by applicable standards of medical practice. We may link to third-party websites; such links do not imply endorsement, and your use of third-party sites is at your own risk.

Limitation of Liability

To the fullest extent permitted by applicable law, Ora Medical Clinic, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill, arising out of or related to your use of the Site, to the fullest extent such liability can be limited by law. Nothing in these Terms is intended to, or shall, limit or exclude liability for professional negligence in the provision of medical care, or any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Ora Medical Clinic, its affiliates, and their respective officers, directors, agents, and employees from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another party.

Termination

We reserve the right to terminate or suspend your access to the Site or discontinue services to you, without prior notice, if we determine that you have violated these Terms, engaged in conduct we deem inappropriate or unlawful, or if continuing to treat you falls outside a provider's clinical judgment or licensing authority. Upon termination, you must cease all use of the Site and any content obtained from it. Termination of Site access does not, by itself, terminate any ongoing obligations related to your medical records, which are retained and handled as described in our Notice of Privacy Practices.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in California, except where applicable law requires otherwise. Nothing in this section limits any right you may have to file a complaint with a state medical board or licensing authority.
